MINUTES

Chair Matthew Kennedy opened the meeting at 7:00 p.m.

John Woodsmall, new DPW Director introduced himself to the Commission.

7:05 p.m NOTICE OF INTENT  Lot 54 110 Wachusett Street C.B. Blair Builders, Inc. Assigned to Kenneth Strom   This is a continued public hearing from December 7, 2011.  George Kiritsy represented the Applicant and is proposing to construct a single-family home on a lot within the secondary zone of a perennial stream.  At the last meeting the Commission requested the Applicant flag the mean high annual water mark of the perennial stream.  The new location of the stream expanded the riverfront area on the lot, increasing altered area from 1,800 square feet to 2,925 square feet.  The altered area consists of lawn  and a minimal corner of the paved driveway.  

Ken Strom motioned to close the public hearing, Robert Lowell seconded the motion, all were in favor.  

Ken Strom made a motion to issue a standard order of conditions with a special condition that a demarcation be placed at the limit of alteration to prevent further lawn intrusion.  Michael Scott seconded the motion, all were in favor.  
                        
NOTICE OF INTENT – 27 Eagle Terrace Lot 4 Kaupila – New Single Family Home – The public hearing notice was read.   The public hearing notice was read and the hearing opened.  This project was originally approved in 1995 with extensions granted until 2001, all approvals have expired.  There was fill placed on the lot when the project was originally approved but no home was construction.  There were boulders placed along one edge of the slope, it was clear there was BVW at the bottom of this area.  The Commission requested the Riverfront area and buffer zone  of the wetland system be clearly shown on the plans and native shrubs be planted at the 760 contour line to act as a  buffer.  The hearing was continued to the February 1, 2012 meeting.  

REQUEST FOR DETERMINATION OF APPLICABILITY 38 Reservoir Street C&S Construction Landscaping/Tree Removal The hearing notice was read.   Glenn Krevosky represented the Applicant.  The applicant is applying for a determination on whether landscaping work is subject to the filing of a Notice of Intent.  The plan has a sketch of an intermittent stream.    There is one spruce tree located on the bank of the intermittent stream which the Commission required only be cut down and prohibited the removal of the stumps.  The Commission asked if the property was connected to sewer and contained a septic system, the representative did not know.  Anthony Costello voted to issue a negative determination with the following conditions; the stump of the blue spruce on the banking only be ground and not removed, the additional stump removal be conducted in the Winter when the ground is frozen, and the Commission must be provided with 24 hour notification prior to removal, Kenneth Strom seconded the motion, all were in favor, 7-0.  .  

Approval of Minutes: Mark Helfrick made a motion to approve the September 7, 2011 meeting minutes, Kenneth Strom seconded the motion, all were in favor 4-0, Michael Krikonis, Anthony Costello and Robert Lowell abstained from voting.

Robert Lowell made a motion to approve the December 4, 2011 minutes, Mike Scott seconded the motion, all were in favor 5-0, Matthew Kennedy and Michael Krikonis abstained from voting.  

The meeting adjourned at 8:15 PM.

The next meeting is scheduled for February 1, 2012.


The January 4, 2012 meeting minutes were approved on February 1, 2012.
